Description of the project
During the period of the large-scale invasion, the State Penitentiary Service of Ukraine ensured the evacuation and relocation of prisoners from penitentiary institutions located in areas close to areas where hostilities were taking place, moving them to institutions located in safer areas, which created an additional burden on the system of bodies and institutions for the execution of sentences. Some of the institutions from which prisoners were evacuated were completely or partially destroyed as a result of hostilities and cannot function in the future. In this regard, the problem of ensuring the physical security of prisoners from external threats, as well as the creation and provision of appropriate conditions for the detention of prisoners, has become particularly acute. The problem of keeping persons taken into custody and certain categories of convicts who must be kept in cell-type premises has become particularly acute. The conditions of detention in many pre-trial detention centers and penal institutions do not meet the basic needs of convicts and persons taken into custody and are equated by the European Court of Human Rights to torture, which complicates the achievement of the tasks of correction and resocialization of convicts, reducing the number of repeated crimes and extraordinary events, leads to an increase in the number of decisions of the European Court of Human Rights on violations of the rights of convicts and persons taken into custody in Ukraine and, accordingly, to financial, reputational and image losses for the state. To solve the above problems, there is an urgent need to create modern penitentiary institutions in safer regions with the application and implementation of physical security of prisoners from external threats and current standards for conditions of detention and living space standards. The State Penitentiary Service of Ukraine observes, in the vast majority of penal institutions and pre-trial detention centers, the lack of ensuring the physical safety of prisoners from external threats and proper conditions of detention of prisoners that meet national and international standards, which poses a threat to the life and health of the specified category of citizens, as well as the staff of these institutions. Solving this problem is relevant at the moment and will allow creating a safe environment for the specified categories of citizens, as well as ensuring the resocialization of convicts. Failure to address these problems has such negative consequences as constant complaints from prisoners about the conditions of detention in penitentiary institutions, as well as comments from representatives of the European Committee and the UN Subcommittee against Torture, submissions from the Prosecutor General's Office of Ukraine, the Commissioner for Human Rights of the Verkhovna Rada of Ukraine on the existence of a threat to the life and health of the specified category of citizens. The vast majority of the regime buildings of pre-trial detention centers were built over 100 years ago, and the buildings of penal institutions in the 50s - 80s of the last century, the design of which did not take into account ensuring the physical safety of prisoners from external threats. Providing funding for the construction, reconstruction and overhaul of facilities of the State Penitentiary Service of Ukraine at the level of 3% of the total need in recent years has not allowed to create physical security of prisoners from external threats and has led to a deterioration in the sanitary and technical condition of the facilities. In addition, an additional factor that exacerbates the problem is the evacuation and transfer of prisoners from penitentiary institutions located in areas close to areas where hostilities are taking place to institutions located in safer areas, which has created an additional burden on the system of bodies and institutions for the execution of sentences.
